Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Torqam website and platform (the "Service"), operated by Torqam. By creating an account or using the Service, you agree to be bound by these Terms.

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account, including actions taken by staff you grant access to.

• Paid plans are billed monthly or yearly in advance, as selected at checkout.
• Free trials do not require a credit card and convert to a paid plan only on explicit confirmation.
• Fees are non-refundable except as required by applicable law or expressly stated otherwise.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

You retain all ownership rights to the customer, vehicle, and business data you input into the Service ("Customer Data"). We process Customer Data solely to provide the Service and as described in our Privacy Policy. You are responsible for ensuring you have the necessary rights and consents to submit Customer Data, including personal data of your own customers.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorized access to other tenants' data or to the Service's infrastructure.
• Reverse engineer, resell, or sublicense the Service without our written consent.
• Upload malicious code or content that infringes the rights of any third party.

We target 99.9% uptime for the Service, excluding scheduled maintenance, which we will communicate in advance where practicable. The Service is provided on an "as is" and "as available" basis without warranties of any kind beyond those required by applicable law.

To the maximum extent permitted by law, Torqam shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

We may suspend or terminate your access to the Service if you breach these Terms or engage in conduct that we reasonably believe harms the Service or other customers. Upon termination, you may export your Customer Data for a period of 30 days.

We may modify these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
